Product Liability

 

When a defective or unreasonably dangerous product is placed into the marketplace causing injury the manufacturer, a seller or anyone in the supply chain could be held liable. Manufacturing and design defects as well as failure to warn provide victims of products liability cases a way to collect for their injuries, lost wages and pain and suffering. A manufacturing defect occurs when one of the products does not come out the way all the other ones did. Regardless of whether the manufacturer did all that they could when they were producing the product, if a manufacturing defect is found and that defect causes injury to the consumer, the manufacturer is held strictly liable.

 

Unlike a manufacturing defect which makes one version of the product more dangerous than the other, a design defect leaves each product equally dangerous. Failure to warn or provide sufficient warning labels can also cause injury and is actionable. Some warnings may be too hard to read or placed in an area that the normal user would not check.
