DUI Accident

People driving under the influence pose a huge risk to the safety of themselves and the safety of others. In 2012, 697 fatal DUI accidents occurred in Florida. As well as being a criminal matter, the drunk driver who caused you or your family’s injuries can be pursued for civil liability. Punitive damages, which are awarded to punish the defendant, can be awarded in these instances. To receive punitive damages, the plaintiff must show clear and convincing evidence that the driver under the influence was engaging in deliberate misconduct or gross negligence.

The driver is not the only one who could be held responsible for your injuries. Certain laws hold a bar or entertainment center owner liable for your injuries. For example, when a bar owner serves a habitual drunk or an underage person, they expose themselves to liability. Davis law LLC will listen to the circumstances of your claim and make recommendations on how to proceed in the collection of money for pain and suffering, medical bills and property damage.
