Dog Bite Injury

 

When a person is lawfully on public or private property and is bitten by a dog Section 767.04 imposes strict liability (Children under 6 years of age do not have to be lawfully on the premises to collect). Strict liability in this instance means regardless of whether the dog has attacked before or whether the owner had, or should have had, knowledge of the dogs violent propensity the owner is liable for the damages caused by the dog attack.

 

Dog bites not only can result in tissue damage and scars but when trying to avoid the attack, people often injure themselves by falling or tripping. Owners of the dogs may have defenses such as posting a “Bad Dog” sign on their property, claim that you were a trespasser or teasing the dog. The victims of dog bite injuries include the mail man, police offers, independent contractors and houseguests.
